Defendant City of Tempe ("Tempe") submits the following Proposed Revisions to the Jury Instructions Suggested by the Court. Specifically, Tempe proposes to: (1) Revise the Public Employee Speech Instruction to reflect the most recent U.S.

Supreme Court decision on the definition of "public concern" (attached); (2) Insert Ninth Circuit Model Instruction Section 15.4 entitled "Work as a Major Life

Activity" (attached); (3) Retain the Court's suggested Section 15.8 entitled "Reasonable Accommodation"

(in lieu of Plaintiff's Proposed Instruction); (4) Insert Tempe's Proposed Instruction entitled "The ADA Interactive Process for a

Reasonable Accommodation" which was agreed upon by Plaintiff as well (attached); (5) Insert Tempe's Proposed Instruction entitled "No Accommodation Owed for

`Regarded As' Disability" (attached);
