Pursuant to Rule 36 of the Federal Rules Of Civil Procedure, Bard Peripheral Vascular,
Inc. (“BPV"), formerly named "IMPRA, Inc.," responds as follows to Gore’s First Set Of ·

Goldfarb with respect to ePTFE vascular prostheses to IMPRA after it acquired IMPRA in 1996. `
· Thereafter, as of February 21, 1997 Dr. Goldfarb executed and entered into with IMPRA an
Agreement Amending License Agreement, whereby the original License Agreement between Dr.
Goldfarb and Bard, through its USCI Surgical Products Division, was amended in various ways,
including inter alia, substituting IMPRA for the USCI Surgical Products Division of Bard.
Although no assent was necessary, by executing that amendment, Dr. Goldfarb assented to the
new arrangement.
REQUEST TO ADMIT NO. 245: n _
Dr. Goldfarb did not sign Bard's assignment to Impra of Bard's license to the ’l35 patent.

V has made reasonable inquiry and the information known or readily obtainable by
it is insufficient to enable it to admit or deny Request N0. 245, because Il\/[PRA has not located a
separate document assigning Bard’s License Agreement with Dr. Goldfarb to IMPRA.

ll\/[PRA specifically objects to Request No. 246 on the grounds that it is vague, unclear,
, imprecise, and ambiguous in, inter alia, its use ofthe phrase "at or about the tirne." Without
V. waiving its general or specific objections, and construing the phrase “at or about the time" to ·
h continue into early 1997, IMPRA denies Request No. 246.
