Defendant through counsel files his supplement exhibit for his 404B response #1057. Attached is a portion of the sentencing transcript in State v Augustiniak, CR2002-09736 and CR 2003030238-00SE (relating to the uncharged conduct "The bar assault") which was dismissed as part of his plea agreement. The government's alleges that Gary Dunham's admission that he was Augustiniak's sponsor in the HAMC somehow leads directly to the conclusion that HAMC "displayed its support for Defendant Augustiniak's violent acts, and continue to allow him to remain a full patched member of the Hells Angels." Reply, p.4, ll.8-11. Gary Dunham testified from personal knowledge to the events of that incident which are

quite different from the government's allegations. He also told the court that his support of Kevin consisted of helping Augustiniak with his drinking problem. Contrary to the government's assertion, the facts do not

support the conclusion that HAMC "supported" or "rewarded" Augustiniak for unrelated violent conduct and therefore, justify its admission.
