15 has been made aware of new material in the possession of law enforcement that may be 16 discoverable in light of previous orders of this Court. On January 3, 2005, during a meeting in 17 preparation for trial, the United States Attorney's Office learned from ATF that there are 18 additional materials (recordings and documents summarizing those recordings) that were not 19 previously known to the United States Attorney's Office or given to the United States Attorney's 20 Office. The relevance, materiality or discoverability of those materials is not known until a 21 thorough review is conducted. That review is currently underway. We will conduct this review 22 as expeditiously as possible and, depending on a detemination of the nature of the material and 23 the court's previous rulings, disclose, seek a protective order, or notify the court of the 24 nondiscoverable nature of the material as appropriate. 25 26 27 28 Respectfully submitted this 6th day of January, 2006.
