ORDER RE-INSTATING PROBATION

A petition for probation having been filed and hearings held with the defendant and counsel present, and the Court having found the defendant guilty of violation of special condition #3 (allegation E) on 1/16/2008, IT IS ORDERED re-instating the defendant's probation for a term of FIVE (5) YEARS, to date from June 20, 2005 under the standard conditions of probation as stated in the General Order 0536 and the following special conditions: 1. You shall submit your person, property (including but not limited to computer, electronic devices, and storage media), residence, office, or vehicle to a search conducted by a probation officer, at a reasonable time and in a reasonable

manner. 2. You shall provide the probation officer access to any requested financial information. 3. You are prohibited from making major purchases, incurring new financial obligations, or entering into any financial contracts without the prior approval of the probation officer. 4. You shall cooperate in the collection of DNA as directed by the probation officer. 5. You shall not travel outside the District of Arizona for any purpose without the prior approval of the Court of the probation officer. You are to submit a written request for

travel with an itinerary to the probation officer ten (10) days in advance. In unforeseeable circumstances do not allow

for ten (10) days advance notice, you are to request permission with as much advance notice as possible. In the

event you need to travel immediately and are unable to reach the probation office, you must fax to the probation officer your travel itinerary and plans for travel. 6. When requested by the probation officer, you are to provide to the probation officer all lease agreements for any residence in which you reside. In addition, you shall provide all lease

agreements for any office space your business occupies, regardless of the name on the lease.

You shall allow a probation officer from the Northern District of California to conduct home and office inspections at any time and shall permit confiscation of any contraband observed in plain view by the probation officer.

You shall submit complete monthly bank statements for any and all accounts, personal or business, with your Monthly Supervision Report. You shall submit complete monthly credit

card transaction records for any and all credit cards, personal or business, with your Monthly Supervision Report. 9. You shall cooperate with the probation officer in determining your ability to pay restitution. All income, employment

benefits, personal expenses, and employment expenses are to be reported to the probation officer monthly. 10. You shall pay $700 per month toward restitution, effective June 1, 2008. IT IS ORDERED dismissing the remaining allegations as set forth in the Petition. The defendant is advised of his right to appeal within 10 days. DATE DISPOSITION IMPOSED: June 17, 2008.
