CON S NOW INTO COURT the Petitioner Rafael Joy, Jr., acting in
Propia Persona and respectfully files his Motion Requesting Clarification
of Sentence on Petit1oner's Judgment in a Criminal Case. . I
. In support thereof, Petitioner states as follows: :
.1. On or about the 2nd day of August, 2005, Mrs. L. Wilson,
Case Social Worker, called Petitioner into her office and apprised
him that she had submitted all the required paperwork for his halfway 1
_ house placement. ' 0
. 2. On or about the 27th day of September, 2005, Mrs. Wilson . .
apprised Petitioner that he had been accepted for halfway house U
placement in Tucson, Arizona, on July 7, 2006. J
3. Then, Petitioner was apprised by Mrs. Wilson that the
Bureau of Prisons denied his halfway house placement because, apparently,
the Honorable Judge who sentenced him ordered the Bureau of Prisons to · *
place Petitioner for 180 days after his completion of his 30 month sentence.

A. Petitioner's understanding was that he was sentenced to a term
of incarceration of 30 months in custody of the Bureau of Prisons. However,
the Bureau of Prisons is adding six (6) months to his original sentence by .
placing him for 180 days, after he has completed his original sentence, at
the halfway house. ~ A
5. It is Petit1oner's understanding that once an inmate completes a
program such as, boot camp, and the 500 hour Residential Drug Abuse Program, e
he is mandated to complete at least 180 days at the halfway house. Bevertheless,
Petitioner did not take either program, for the boot camp program was
cancelled by the Bureau of Prisons and there is a long waiting list to U
take the 500—hour Residential Drug Abuse Program.
6. Petitioner has completed many programs offered by the Bureau of Prisons
such as, Parenting Program, and the following Adult Continuing Programs:
Mortgage, real estate, sports, and how to maintain good status at work.
Moreover, Petitioner is currently in the waiting-list for the 40 hour A
Drug Abuse Program. U
WEEREPURE, Premises Considered, Petitioner prays this Honorable Court
to grant the instant motion and clarify to the Bureau of Prisons that he was U
l sentenced to 30 months incarceration and not 30 months plus 180 days of
halfway house upon completion of his 30 month sentence. Also, that Petitioner
be allowed to go to the halfway house on July ?, 2006.
