The Court has received Defendant's Request for Home Confinement (doc. # 113) and the Government's Response (doc. # 116). The Court lacks jurisdiction to modify Defendant's sentence on the unilateral request of the Defendant. Rule 35, Fed. R. Crim. P. In any event, the circumstances asserted in the Request are not different from what was foreseeable when the Defendant entered into his plea agreement, pursuant to which he pleaded guilty and pursuant to which he was sentenced. IT IS THEREFORE ORDERED that Defendant's Request for Home Confinement (doc. # 113) is denied. DATED this 7th day of March 2006.
