Flow Chart of Jury Selection Process Mid-November: Questionnaire submitted to potential jurors (covering juror attitudes and knowledge of pre-trial publicity, death penalty, hardship, length of trial, etc.) Done at the Courthouse, in groups of 100 jurors at a time, perhaps two such groups per day Questionnaires returned, provided to counsel, reviewed By mid-December: Counsel meet without Court to decide on any agreed-upon strikes for cause, hardship or Morgan/Witt/Witherspoon; then with Court to make record on agreed-upon strikes Parties meet with Jury Commissioner to help schedule smaller panels of jurors to return for oral voir dire Remaining jurors are called in panels for individual voir dire (5 to 15 per day depending on the efficiency with which they are processed) "Surviving" jurors are called back in larger groups (and in order of their randomly assigned juror number) for general voir dire Once sufficient number of jurors has been passed by both sides on all issues to constitute 12 + number of alternates (6?) + number of government peremptories + number of defense peremptories, voir dire is complete Peremptory strikes are done in alternating fashion (Arizona state method) instead of simultaneously so each side gets full and intelligent use of all peremptories Alternates are chosen at outset of trial (federal method) but could be called into box out of order so jurors do not realize they are alternates
