Case No. CR-03-573-PHX-EHC MOTION TO CONTINUE SENTENCING HEARING

COMES NOW Defendant Eliseo Zapata-Rodriguez, through counsel, and hereby moves this Court to continue the Sentencing hearing, which is presently scheduled for Tuesday, January 3, 2006 for a period of 45 days. The reason for this motion to continue is that counsel was just recently reappointed to represent Mr. Zapata and has not had an opportunity to meet with him due to counsel having been ill with the flu during the past week. In addition, counsel has not received the file from appellate counsel, Alex Gonzales. Concerning the government's position regarding this motion, it is unknown, since Ms. Pfister will be away from the office through January 3, 2006. Should this motion be granted, it is respectfully requested that the Court note that undersigned counsel is scheduled to be out of town from January 23, 2006 through February 3, 2006.
