Petitioner’s filings are construed together as a petition for writ of mandate
challenging the district court’s judgment and sentence. Petitioner’s direct criminal
appeal, however, is pending in this court in appeal no. 06-10429. Accordingly, the
petition is denied because this case does not warrant the intervention of this court
by means of the extraordinary remedy of mandamus. See Bauman v. United States
Dist. Court, 557 F.2d 650 (9th Cir. 1977). g
