COMES NOW PROBATION OFFICER ASSISTANT Alicia R. Pineda presenting an official report
on Jose CASTRO—GARClA who was committed to the Bureau of Prisons February 12, 2001, by the
Honorable Roslyn O. Silver presiding inthe District Court of Arizona. A 36-month period of supervised
release was imposed, and supervision commenced upon the offender's discharge from imprisonment
October 25, 2002. In addition to the general terms and conditions adopted by the court in General Order
04-11, the offender was ordered to comply with the following special conditions:
1. lf deported, you shall not re—enter the United States without legal authorization.
Jose CASTRO-GARCIA was convicted of Re-entry After Deportation, a violation of 8 USC §1326(a)&
(b)(2), a Class C felony.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE
AS FOLLOWS: .
Allegation A. Violation of Special Condition No. 1: if deported, you shall not re-enter the United
States without legal authorization.
On or about October 14, 2005, Castro-Garcia entered the United States without legal authorization as
evidenced by his October 14, 2005 arrest by the Cheyenne, Wyoming Police Department. He was
convicted that same day of Public intoxication, a violation of Cheyenne City Code 9.08.110, in the
Cheyenne, Wyoming Municipal Court, CR-0510-0157, and was sentenced to five days jail. Grade C
Violation, §7B1.1(a)(3).
