Plaintiff filed a Motion to Change Counsel and Obtain New Counsel. [Dkt. 85]. The Court held an ex-parte hearing on August 12, 2005 addressing Plaintiff's Motion. Plaintiff's Counsel, Darius Nickerson, appeared for the hearing; Plaintiff was not present. Attempts to reach Plaintiff at the telephone number he provided were unsuccessful. The Court discussed the Motion with Plaintiff's Counsel, who agreed to withdraw from the case. Accordingly, IT IS ORDERED that Plaintiff's Motion to Change Counsel and Obtain New Counsel is GRANTED IN PART, and that Darius Nickerson is withdrawn as Plaintiff's Counsel. [Dkt. 85]. IT IS FURTHER ORDERED setting a status hearing for Monday, September 19, 2005 at 10:30a.m. to discuss further proceedings in this case. Plaintiff is to personally appear at the hearing.
