On September 11, 2007, Petitioner filed a Motion to Determine the "Status" of his Motion filed March 27, 2007 regarding dismissal of his Habeas Petition. (Dkts. 60, 62). This Court adopted the Report and Recommendation of the Magistrate Judge (Dkt. 49, March 29, 2006) and dismissed the action. On January 25, 2007, the Ninth Circuit denied Petitioner's Certificate of Appealability of the March 29, 2006 Order and the appeal was terminated. (Dkt. 58). Accordingly, IT IS ORDERED denying Petitioner's Rule 60(b) Motion filed March 27, 2007 as moot (Dkt. 60); IT IS FURTHER ORDERED denying the Motion for Status as moot.(Dkt. 62).
