held; this peeiiieu fer 17 years. I have overseen the eenetrueticn of the City of Newark Water
Supply Reserv·0i1·{tl1e "Reservei1·” or “P1·ujeet”] since the Project was taken ever by G&L in ·
Mamh, 2004. ‘
3. In April, 20DS e. subeoutreemr te {3·&L, NA?/Tech, surveyed the Reseweix and
_ placed grade stakes eu the bemhes and the crest en the east side efthe Reserveir.

4. A “beneh" is e horizontal break in the interior slope ofthe Reservoir

· 5. Grade stakes are surveying markers which guide G&L in constructing the
Reservoir in accordance with the constructions drawings ami speoiiioetions.
6. While operating s bullctosxer to eoostroet the interior slope in the are ofthe 12+00
stsiiou ou June 22, 2005 Freeois Edwards, s G&L employee who is rtbmilier with the Project
design requirements, suspected something was smiss and caused en investigation to tske piece
regerdiog the location of the grade stakes.
7. The investigation revealed that the grade stakes fiom the 159 foot beech had been
switched with the grade stakes fiom the crest med at the top ofthe etrxbaxxiuueiit
8. _ The emotion of swapping the erode stakes, ifuot discovered, would have eeused
_ Ci&L to begin construction of the embankment improperly and contrary to the oonsouctiou
drawings mad specifications.
9. It is my beiiefthst the grade stakes were switched by eu individual who is
lmowleclgeeble shout surveying sod gzrede stakes. A person who wes not imowledgeeble shout
su1·veyi1:1g end layout would not mmdersteod bow the staking system works and would therefore
be unable to undermine such eeretixl and ceieulated sabotage to G&L’s womk and the Project.
