COMES NOW the undersigned attorney for Plaintiff Jose Castillo ("Castillo"), and moves this Court for an extension of time for Plaintiff to reply to the Cross Motion for Summary Judgment. This is Plaintiff's Fourth request. The response is presently due on December 6, 2005. Plaintiff moves for the extended date of December 15, 2005. Plaintiff's counsel spoke to the Defendant's counsel who has no objection. This extension will not prejudice either party as the parties are set for a Settlement Conference on January 11, 2006 in Tucson.
