Non-Infringement of U.S. Patent No. 6,013,096 ("Reply"). In support of the present Motion, the undersigned states as follows: 1. 2. The Reply is currently due on or before August 11, 2006. The undersigned has been diligently preparing the Reply. However, as of

the filing of this Motion, the Reply is not completed. 3. The undersigned's wife has begun labor two weeks early and should

hopefully deliver a beautiful, healthy baby boy within the next twenty-four hours. It goes without saying that the undersigned will be unable to complete the Reply, or assist in its completion, by the current deadline. 4. It would be unfairly prejudicial to REM, and REM would necessarily incur

duplicative attorney's fees and costs, if another attorney were required to complete the Reply on an expedited basis to meet the current deadline, and without the aid of the undersigned's intimacy with the facts and issues raised therein. 5. The undersigned's assistant has conferred with counsel for Plaintiffs

Erchonia Medical, Inc. and Kevin Tucek concerning the present Motion and there is no opposition to the relief requested herein. WHEREFORE, for the foregoing reasons, the undersigned respectfully requests a two-week extension of time to complete and file REM's Reply in Further Support of Its Consolidated Motion for Summary Judgment of Non-Infringement of U.S. Patent No. 6,013,096.
