The Joint Parties hereby give notice that they will bring Dr. David Posner, Lexcel's

21 Phase I expert, to the hearing scheduled by this Court on analytic dissection so that he may 22 provide expert testimony intended to aid the Court in conducting any necessary analytic
th 23 dissection. See, e.g., Brown Bag Software v. Symantec Corp., 960 F.2d 1465, 1473-74 (9

24 Cir. 1992) (noting that expert testimony may be helpful in analytic dissection of computer 25 software). Dr. Posner has already submitted a detailed expert report during the Phase I 26 summary judgment proceedings, as well as an affidavit in support of the Joint Parties' 27 Response to Nelcela's Opening Brief re Analytic Dissection that is consistent with that 28 report.
