By order of July 28, 2008 (Docket No. 385), the court scheduled a retrial in this case for February 16, 2009. In this order, the court

indicated to counsel that trial of this case would commence following the trial of Selby v. Phoenix Symphony, No. 2:07-cv-1254. Because of scheduling problems encountered by the court, trial of the Selby case has been continued to February 23, 2009, so the Selby case will be no impediment to commencement of the retrial in this case. However, it has come to the court's attention that February 16, 2009, is a court holiday and, therefore, retrial in this case will commence on Tuesday, February 17, 2009, at 9:00 a.m., and is expected to conclude on or about February 19, 2009.
