16 bankruptcy ease In Re Xeba, Inc.; Case No. 2:03—bk»l8093-RJ H (the "Xeba
17 Bankruptcy").l
18 The Xeba Bankruptcy remains active. Neither counsel of record for plaintiff nor
19 counsel of record for Xeba in this action are involved in the Xeba Bankruptcy. Indeed,
20 counsel of record for Xeba is no longer a member of the firm engaged to represent it.2
2l Nevertheless, counsel for Xeba has spoken with Lisa Banen, co-counsel for the
22 bankruptcy Trustee, regarding the status of the proceeding. Ms. Banen advises that the
23 Trustee continues to pursue claims on behalf of the estate. Ms. Banen further advised that
24 most of the estate’s claims are encumbered by Comerica Bank and that any recovery by
