Lawrence J. Warfield, as the court appointed Receiver, respectfully petitions the Court as follows: 1. On April 3, 2002, this Court entered its Order Appointing Temporary

Receiver, which appointed Lawrence J. Warfield as Receiver of all of the assets of U.S.

On April 10, 2008, the Receiver filed his Status Report (Dkt. 723), which

identified two pending claim matters. 3. On June 24, 2008, the Court entered its Order (Dkt. 727) directing the

Receiver to file not later than July 15, 2008, either the final recommendations regarding the claims of Horst Dopp and the Court appointed liquidator of Secure Finance and Investment Services, or a status report regarding their claims. 4. The Receiver has completed his analysis of the claim by Horst Dopp and

attached as Exhibit "1" is the Receiver's Claim Recommendation Regarding Horst Dopp dated June 27, 2008. In his report the Receiver recommends that Mr. Dopp's claim be approved in the amount of $90,514.29 and that the Receiver be authorized to make an interim distribution on this claim of $66,102.59. 5. The claim of the Court-appointed liquidator of Secure Financial and

Investment Services is addressed in the Receiver's Claim Recommendation Regarding Claim by Liquidator of Secure Finance and Investment Services Pty Ltd (In Liquidation), dated July 1, 2008. In the report the Receiver recommends that the communications received from the Liquidator be treated as a claim and denied for failing to file a formal proof of claim and as untimely.

WHEREFORE, the Receiver respectfully requests that the Court enter an order: 1. 2. Approving the claim filed by Horst Dopp in the amount of $90,514.29. Directing the Receiver, not less than sixty (60) days and not more than

ninety (90) from the date of this order, to make an interim pro-rata distribution to Horst Dopp on his approved claim in the amount of $66,102.59. 3. Services Ltd. 4.
