Petition to Revoke Supervised Release “ E
COMES NOW PROBATION OFFICER J. Todd Davison presenting an official report on
Roberto Shazam Yazzie who was committed to the Bureau of Prisons on November 4, 2005, by
the Honorable l\/lary H. l\/lurguia presiding in the District Court of Arizona. A 29—month period of
supervised release was imposed, and supervision commenced upon the offender's discharge
from imprisonment on April 13, 2006. ln addition to the general terms and conditions adopted by
the court in General Order 05-36, the offender was ordered to comply with the following special
conditions;
1. The defendant shall participate in a program of alcohol aftercare as directed by the
probation officer. Cost of the treatment and testing to be paid by the defendant and the
government based upon the defendants ability to pay.
2. You shall submit your person, property (including but not limited to computer, electronic
devices, and storage media), residence, office, or vehicle to a search conducted by a
probation officer, at a reasonable time and in a reasonable manner.
3. You shall reside and participate in a community corrections center for up to 180 days
unless discharged earlier by the probation officer.
4. You shall abstain from all use of alcohol or alcoholic beverages.
5. You shall cooperate in the collection of DNA as directed by the probation officer.
6. The defendant shall participate in an anger management program and sex offender
treatment program to include physiological testing. Cost ofthe treatment and testing to be
paid by the defendant and the government based upon the defendant's ability to pay.
On April 19, 2000, Roberto Shazam Yazzie was convicted ofAssault with a Deadly Weapon with
Intent to do Bodily Harm, a Class C felony, in violation of 18 U.S.C. 113(a)(3) and 1153.

RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR
CAUSE AS FOLLOWS:
1. Violation of Special Condition No. 6: "The defendant shall participate in an anger
management program and sex offender treatment program to include physiological
testing. Cost of the treatment and testing to be paid by the defendant and the
government based upon the defendant's ability to pay"
On September 16, 2006, the defendant was discharged from his sex offender treatment
program for failure to attend. A Grade C violation, 7B1.1(a)(3).
2. Violation of Standard Condition No. 7t "You shall notifythe probation officer at least ten
days prior to any change of residence or employment"
On September 1, 2006, the defendant reported that he had moved to a new residence. He
provided no prior notice of his intent to re-locate and has provided no information
concerning his current residential status. A Grade C violation, 7B1.1(a)(3).

ISSUED
ln conformance with the provision of 28 U.S.C. § 1746, I declare, under penalty of perjury, that
the foregoing is true and correct to the best of my knowledge. Based on the information
presented that the offender has violated conditions of supervision, l am petitioning the Court to
issue _a warrant.
