CR 02-1139-3-PHX-JAT ORDER REVOKING PROBATION

A Petition to Revoke Probation has been filed and defendant has admitted the allegation that he violated standard condition #8, special condition #4, and the monetary penalties condition of his conditions of probation. The Court finds the defendant has violated the terms and conditions of probation and has considered the factors in 18 U.S.C. ยง 3553, the U.S. Sentencing Commission Chapter 7 policy statements as well as the original guideline range, and the disposition reports and any attachments. Accordingly, IT IS THE ORDER OF THIS COURT that defendant's probation is REVOKED. IT IS FURTHER ORDERED committing defendant to the custody of the Bureau of Prisons for a term of TIME SERVED. IT IS FURTHER ORDERED following incarceration, defendant is placed on supervised release for TWENTY-FOUR (24) MONTHS. IT IS FURTHER ORDERED affirming standard conditions of supervision adopted by the Court in General Order 05-36. The Defendant shall comply with the following additional conditions:

You shall participate as instructed by the probation officer in a program of substance abuse treatment which may include testing for substance abuse. You shall contribute to the cost of treatment in an amount to be determined by the probation officer.

You shall submit your person, property (including but not limited to computer, electronic devices, and storage media), residence, office, or vehicle to a search conducted by a probation officer, at a reasonable time and in a reasonable manner.

3.

You shall provide the probation officer access to any requested financial information. You are prohibited from making major purchases, incurring new financial obligations or entering into any financial contracts in excess of $1,000 without the prior approval of the probation officer.

You shall participate in a Home Confinement Program with electronic monitoring under the sanction of detention for a period of 180 days. You shall contribute to the cost of electronic monitoring in an amount to be determined by the probation officer.

You are prohibited from owning, maintaining or using a firearm. You shall abstain from all use of alcohol or alcoholic beverages. You shall not obtain employment with any company or entity involved in the mail order business, either directly or indirectly, without first obtaining approval from the probation officer.

You shall notify your employer of your conviction immediately and notify any prospective employer upon seeking employment.

You shall pay a fine of $30,686, in regular monthly installments of not less than $500 to be remitted to the United States Postal Service, with credit for monies paid to date. Of particular importance among the standard conditions, you shall not commit another

federal, state or local crime during the term of supervision; you shall report to the nearest United States Probation office with 72 hours from release, and you shall abstain from the use of illicit substances.
