This Notice is made in good faith,and in the best interest of
justice.
FACTUAL BACKGROUND :
On Ju1y,15,2005,mx Gauna filed a pro-se motion to vacate,set/aside,
or correct sentence,under 28 U.S.C.§ 2255,"1eaving an OPEN DOOR
to raise other issues,on Sept,14,2005,Mr Gauna filed an Open Door
issue,arguing the constitutionality of his sentence,or of the
Jury's verdict.
On,or about Oct.11/2005 Magistrate David K.Duncan,recommended _Â¥{)

‘Petitioner‘s motion to be denied.,on Oct.25/2005,Mr Gauna Obje-
cted to such recommendation.
On Dec.O8/2005,teh district court entered JUDGEMENT denying
relief.
Now,Mr Gauna gives notice of appeal to such judgement.
The District Judge claims,that;TWO issues were presented before
the c0urt,but Mr Gauna added one more through the OPEN DOOR
established in his original petition
1.Mr Gauna claims,that;Blakely "did" not over rule Apprendi,but
l forces the courts to prove beyond a reasonable doubt,any judicial
factfinding not admitted by the defendant -
2.Claims that his sentence is in violation of the Speedy Trial Right
Act.
3.Claims that his sentence was in violation of due process,and the
right to a just and fair trial,due that the jury "found him" guilty of
three different,distincts offenses.,in one count 8 U.S.C.A.§ 1326.
Mr Gauna will be presenting a brief,with the proper legal authori-
ties,and law cases.

Mr Gauna,will be submitting a forma pauperis form,in the future time
due that;he is indigent.,but at this time the most important thing
is not to run out of time for the appeal.,and to gather the info-
rmation for the forma pauperis f0rm,takes time here in prison.
