STIPULATION SETTING TIME
FOR DEFENDANTS TO RESPOND TO COMPLAINT
WHEREAS, defendants Biovail Corporation ("BiovaiI"), Biovaii Laboratories
International. SRL (“Laboratories") and Biovail Technologies, Ltd. ("Tech;noiogies")
have each agreed to waive service of process pursuant to Fed.R.Civ.P. 4(d); and
WHEREAS, plaintiff Wyeth has no objection to Technologies, a Delaware
corporation, responding to the complaint at the same time as Biovaii and Laboratories,
iiorndomestic entities;
NOW, THEREFORE, IT IS STHDULATED AND AGREED, by and between the
parties hereto, through their undersigned attorneys and subject to the approval of the
Court, that the time within which each of Biovail, Laboratories and Technologies shall
answer, move or otherwise respond to the complaint herein shail be September 25, 2008.
