\Vi~IEREAS, Plaintiff St. Clair Enteliectual Property Consultants, Inc. (°‘Plaintift") filed its
Complaint for Patent Infringement Complaint ("Co1npIaint"} against Defendants Fujifilm
Holdings Corporation, Fujifilm Corporation, Fuji Photo Finn Co., Ltd., Fuji Photo Filnz USA.,
Inc., Fujifilm USA., Inc., Fnjiiiim America, Inc. ("FnjiIil1n Defendants") on June 20, 2008; and
WHEREAS, the Fujifilm Defendants have authorized their attorneys, Orrick, Flerrington
& Sutcliffe LLP, to waive formal service of Plaintiff" s Sunnnons and Complaint in this action
_ and to accept service on their behalf; and
WHEREAS, in exchange for waiving formal service of Plaintifi” s Suinmons and
Complaint, St. Clair agrees that the Fujifilm Defendants wiil have until October 17, 2008 to
respond to Piaintiff`s Complaint.
NOW, THEREFORE, in accordance with the Ftijiiilni Def`endants’ authorization, the
undersigned attorneys for the Fujililm Defendants acknowledge that service of Plaintiffs

Complaint is hereby accepted on behalf of the Fujifilm Defendants, and it is hereby stipulated
