The failure of a junior party to file a priority motion is construed as a concession of priority. Accordingly, it is appropriate to enter judgment. 1 37 CFR § 41.127(b). It is ORDERED that judgment on priority as to the subject matter of Counts 1 and 2, Paper 1 p. 3) is awarded against Human Genome Sciences, Inc.; FURTHER ORDERED that Human Genome Sciences, Inc. is not entitled to a patent containing claims 1-6, 8-19, 21-32, 34-45 and 47-52 (corresponding to Count 1) or claims 7, 20, 33, 46 (corresponding to Count 2) of Patent 6,872,568; FURTHER ORDERED that claims 1-52 of Patent 6,872,568 be CANCELED, 35 U.S.C. § 135(a); FURTHER ORDERED that a copy of this judgment be made of record in the file of Patent 6,872,568, and Application 10/423,448; and FURTHER ORDERED that if there is any settlement agreement which has not been filed, attention is directed to 35 U.S.C. §135(c) and 37 CFR § 41.205.
