1. I, along with Richard L. Horwitz, am local counsel for defendant Mirowski
Family Ventures, L.L.C. ("MFV"). ·
2. The designation "JURY TRIAL DEMANDEIY under the civii action number in
MFI/"s answer and counterclaim was meant to refer to the fact that Medtronic demanded a jury
trial and not to request a jury trial on MFV’s counterclaim. It is my understanding that this
designation is in confonnity with local practice.
