Instructions for completing Motion to Re-Examine Probate Will (NHJB-2243-P)

Form Use. This form is used to ask the court to re-examine the probate of the will already accepted by the court, when there may be a question about the validity of the will. Top part of form COURT NAME: Enter the name of the county probate court where the document will be filed. (example: Belknap County Probate Court; Rockingham County Probate Court). ĚCASE NAME: Enter the name of the deceased. (example: Estate of John Q. Adams or Estate of Susan Jones). ĚCASE NUMBER: Leave blank if not yet assigned by court OR fill in case number if it is known. Numbered part of form 1. Enter the name of the person filing the motion with the court. Also enter that person's relationship to the deceased (son, daughter, legatee, etc.), that person's complete mailing address including zip code, and telephone number. 2. Enter the name of the person who is the executor of the will along with that person's complete mailing address including zip code, and telephone number. 3. Enter the date when the will in question was allowed (or accepted) by the court as the deceased's last will and testament. 4. Select which action you want the court to take. The first option asks the court to reexamine the will by questioning the witnesses to the will. The second option asks that the will be re-examined based on specific allegations which should be included in a separate attached document. Specific allegations might include such things as proving to the court that the will was done under fraud, duress or incompetence. Signature Section The sentence prior to the signature section indicates that the person filing this document has provided copies to all attorneys, parties and persons beneficially interested in the case. This form must be signed in the presence of a Notary Public or Justice of the Peace. They will complete the section immediately following your signature. You will sign the form on the Signature line, and date it in the appropriate space to the left.
