Instructions for completing Petition/Motion for Ex Parte Attachment
(NHJB-2181-DPS) Form use. This form is used by a party (plaintiff or petitioner) to request an attachment against another party (defendant or respondent) without notice to that party. Either party can be an individual, business or corporation. This form may be used in district, probate and superior courts. Page 1 Top part of form. ·COURT NAME: Enter the name of the court where the document will be filed. (example: Belknap County Probate; Rockingham County Superior Court, Concord District). ·CASE NAME: Enter the name of the case putting the petition/plaintiff and respondent/defendant on the appropriate lines. ·CASE NUMBER: Leave blank if not yet assigned by court OR fill in case number if it is known. Box part of form Name of Defendant/Respondent: Enter first and last name of the person in the first blank box. Category of Property to be attached: Check off either the Real Estate box or Other box and if real estate also enter the name of the property that you wish to attach. Provide the address location or the book and page number as listed at the Registry of Deeds where the property is recorded. Other: If it is another type of property, enter the property description in this box. Amount of Attachment: Indicate the dollar value of the attachment you wish to secure. Section A: Write in detail the information that supports this petition. Section B: Check off one box, which reflects the grounds for the attachment. If the "Other" box is checked, provide detailed information. Attach additional pages if necessary. Signature section This form must be signed in the presence of a Notary Public or Justice of the Peace. They will complete the section immediately following your signature. You will sign the form on the Petitioner/Plaintiff Signature line, and date it in the appropriate space to the left. If there are two petitioners, both petitioners must sign and date the form. Order This section will be completed by the judge once the document is filed with the court and reviewed in detail by the judge. Notice to Defendant/Respondent The notice in this section informs the defendant/respondent of important information relative to the attachment process and provides a deadline date to notify the court or file an appearance. The clerk of court or the register of probate signs this notice. Review the completed form for accuracy prior to filing it with the court. If completing this form on-line, some fields may be filled in automatically based on entries in other fields. If more space is needed for any question, please attach additional sheets of paper.
