No. 08-133 C (Filed: March 19, 2008) ******************************************* GLOBAL COMPUTER ENTERPRISES, INC., * * Plaintiff, * * v. * * THE UNITED STATES, * * Defendant, * * and * * QSS GROUP, INC., * * Defendant-Intervenor. * ******************************************* ORDER On March 17, 2008, defendant-intervenor filed a Motion to Dismiss for Lack of Jurisdiction and, Alternatively, Motion for Judgment on the Administrative Record ("motion"), a memorandum in support of its motion, a separate appendix to its motion, and a Motion to Admit Harm Declaration of William R. Bowen and to Strike Improper Lay Opinion Testimony From Declarations in Support of Plaintiff's Motion for Preliminary Injunction and Application for Restraining Order. The Clerk of the Court noted that defendant-intervenor's motion did not comply with RCFC 5.3(a)(1)(A) and RCFC 5.3(a)(1)(G), which require that the contents of any appendix be listed in the brief's table of contents as well as at the beginning of the appendix. The court determines that this deficiency is harmless. Accordingly, the Clerk of the Court is directed to file defendant-intervenor's Motion to Dismiss for Lack of Jurisdiction and, Alternatively, Motion for Judgment on the Administrative Record by leave of the court.
