Defendants1, through undersigned counsel, notices the Court that they received a copy of Plaintiff's Statement of Facts (Dkt. 44) in Support of his Response to Defendants' Motion for Summary Judgment/Cross Motion for Summary Judgment (Dkt. 43). Plaintiff previously filed a Statement of Facts (Dkt. 36) in Support of his Motion for Summary Judgment (Dkt. 35) on February 14, 2006. Defendants filed their Objections to Plaintiff's Statement of Facts on March 13, 2006. (Dkt. 39) Because Defendants previously objected to Plaintiff's Statement of Facts, (Dkt. 39), Defendants will not provide a response to Plaintiff's second set of statements of facts (Dkt. 44) unless directed to do so by the Court.
