The Federal Bureau of Investigation ("FBI"), through the undersigned, hereby moves the
court to dismiss the captioned matter pursuant to Rules 12(b)(l) and 12(b)(6) of the Federal
Rules of Civil Procedure and in support thereof avers as follows:
1. The Court lacks subject matter jurisdiction over the claims set forth in Plaintiffs
Complaint.
2. The Complaint fails to state a claim upon which relief 1nay be granted. A
