IT IS HEREBY STIPULATED, by and among the undersigned attorneys for all parties herein, that: 1. Plaintiffs' claims with respect to U.S. Patent Nos. 5,093,132, 5,433,959,

and 5,026,560 as set forth in the Amended Complaint (i.e. Third, Fourth, Seventh, Eighth, Ninth and Tenth Claims for Relief) in the above-captioned action are dismissed with prejudice. 2. Defendants' claims with respect to U.S. Patent Nos. 5,093,132, 5,433,959,

and 5,026,560 as set forth in the Answer, Defenses and Counterclaims to Amended Complaint (i.e. Counts Two, Four, Five, Seven, Nine and Ten) in the above-captioned action are dismissed with prejudice.

The dismissals set forth in paragraphs 1 and 2 are limited to the products

described in Abbreviated New Drug Application ("ANDA") 77-255, as of the date of the Complaint in this action, January 17, 2006. 4. The parties shall bear their own costs.
