ARTHUR G. CONNOLLY, HI, after tirst being duly sworn, on this 29* day of
December, 2005, does depose and say:
I. E am an attorney with the law firm of Connolly Bove Lodge & Hutz LLP and
represent plaintiff in the above captioned action.
2. On November 29, 2005, I caused a copy of the Complaint, the Surnmons for
Defendant Quixtar Inc., and a letter addressed to Quixtar Inc., and containing the infomation
required by l0 QE; Q, § 3104, to be forwarded, via Registered Maii Return Receipt Requested,
to defendant Quixtar Inc., pursuant to l0 @ Q, § BEO4. The Registered Mail receipt for said
package is attached hereto as Exhibit "A".
3. On December 5, 2005, the package referenced in paragraph 2, was received by
Quixtar Inc. The confirmation/tracking form received from the United States Postal Service is
attached hereto as Exhibit "B".
