Code of Alabama, 1975, §35-16-3 states, "Publication of mortality tables. The superintendent of insurance shall, within 10 days after final adjournment of each regular session of the legislature, cause to be delivered to the secretary of state the then current American experience and commissioner's standard ordinary mortality tables, which the secretary of state shall cause to be printed in the bound volume of the acts of the legislature.

As you are aware, the use of these tables is an integral part of Workers' Compensation claim handling. We have just been advised that The Department of Insurance, through their rule #130 has adopted the use of The Commissioners 2001 Standard Ordinary Mortality table, to be effective 1/1/2004. Furthermore, the adaptation of this has been bound in the Acts of the Legislature. In light of this, it is the opinion of this division, that this table should be used from this point forward.
