DECEMBER 14, 2004

DEFENDANTS' RESPONSE TO PLAINTIFF'S MOTION FOR JUDGMENT DATED NOVEMBER 26, 2004 The plaintiff has filed a one sentence motion requesting judgment "from the incident that took place in Garner Correctional mental health unit." Presumably the plaintiff is referring to the allegations set forth in his amended complaint. On March 18, 2004, the defendants filed a motion for summary judgment with respect to the amended complaint along with several affidavits and exhibits. The defendants would agree that this matter has been fully briefed and hereby renew their request that their pending motion for summary judgment be granted. DEFENDANTS Linda Messenger, et al.
