l5(a) of the Federal Rules of Civil Procedure, he has filed a Second Amended Complaint in the above-
entitled matter. Counsel represents that this Second Amended Complaint is tiled with the consent of g I
defense counsel and following the Status Conference conducted with the court and counsel on October I
30, 2003. In the Second Amended Complaint, counsel has deleted Count S of the Amended Complaint
which alleged negligent intliction of emotional distress and there are no other changes between the
Second Amended Complaint and the First Amended Complaint other than noted herein.
