INSTRUCTIONS FOR COMPLETING A REQUEST FOR ORDER OF PATERNITY
COMPLETE THIS FORM TO REQUEST AN ORDER OF PATERNITY IF: · · · You are the natural parents of a child(ren) born out of wedlock, i.e. the mother was not married at the time of the birth nor at any time throughout the 10 months immediately preceding the birth, and Both parents agree to sign the application, and You want a court order establishing paternity of the child(ren).

SOCIAL SECURITY NUMBER MUST BE PROVIDED. IT CAN BE OMITTED FROM THIS DOCUMENT AS LONG AS YOU INCLUDE IT ON THE CONFIDENTIAL SENSITIVE DATA FORM (ATTACHED).

The complete name and social security number of each parent. (*OMIT SOCIAL SECURITY NUMBER IF USING CONFIDENTIAL SENSITIVE DATA FORM) You might need other documented information as described below. The name, address and phone number of the person filing the form. (An attorney must also list the name of the person represented and the attorney's State Bar Number). (section "a") The name of each of the children for whom you wish to have an order of paternity entered. (section "b") Mark the one box that applies to your request. (section "c") Affidavit of Acknowledgment ­ Mark this box if both parents are signing this request to acknowledge paternity of the child(ren). (Complete Form A) Genetic Testing ­ Mark this box if both parents agree to be bound by the results of genetic testing, and you have a copy of the test results showing that the individual named as the father has not been excluded as the natural father.

Complete the Order of Paternity. Take both forms and any necessary attachments (depending on the box you checked) to the Office of the Clerk of Superior Court. There will be a filing fee. If you cannot pay the fee, it can be deferred or waived. The Clerk has the forms for a deferral or waiver. Page 1 of 1
