On July 21, 2004, defendant filed a motion for summary judgment. On August 20, 2004, plaintiff filed a motion for summary judgment as to liability. Those motions have been fully briefed and are ripe for resolution by the Court. In order to assist the Court in reaching a decision on the pending motions, the parties are ORDERED to appear for oral argument on Thursday, March 17, 2005 at 9:30 a.m. at the National Courts Building, 717 Madison Pl., NW, Washington, D.C. The focus of the oral argument shall be the "warranty and software upgrade" issue, but the parties shall be prepared to address all arguments raised in the briefs. Oral argument will be held in open court and will be on the record.
