_ The United States Postal Seivice ("USPS), through the undersigned, hereby moves the ‘ _
. Court to enter summary judgment in its favor and in support thereof avers as follows: I
II l. Plaintiff Brian K. Reinhold was an employee of the USPS on November 26, 2004,
‘ U when he was removed from his position for failure to follow instructions. _
_ p I 2. It is undisputed that Mr. Reinhold had ahistory of several previous disciplinary
actions, dating back more than one year before the date of his removal. p I .
I 3. In the removal proceeding, the co-defendant National Association of Letter I
I Carriers ("NALC") vigorously represented Mr. Reinbold, as it had in each of the previous .

l - disciplinary actions. The NALC did not breach its duty of fair representation as alleged by
l Plaintiff. As a result, Plaintiff s claim against the USPS must fail. Vasa v. Szpes, 386 U.S. 171,
_ 186 (1967). A _
‘ ` . l 4. Taking all the alleged facts in the light most favorable to Plaintiff, even if the
n NALC breached its duty of fair representation, there is no genuine issue of material fact and the
- USPS is entitled to judgment as a matter of law. ·
1 WHEREFORE the USPS moves the Court to enter judgment in its favor. `
