IN THE UNITED STATES COURT OF FEDERAL CLAIMS

DANNY C. SIMONS AND SALLY J. SIMONS, Plaintiff, v. THE UNITED STATES, Defendant.

) ) ) ) No. 06-115C ) (Judge Braden) ) ) ) )

DEFENDANT'S MOTION TO FILE CORRECTED MOTION TO DISMISS Pursuant to Rules 1 and 5.2 of the Rules of the Court of Federal Claims, defendant respectfully requests the Court grant leave to file a corrected motion to dismiss. In support of this motion, defendant states that when it electronically filed its motion to dismiss it inadvertently failed to attach to the motion the table of contents and table of authorities required by Rule 5.2. The corrected motion would contain the table of contents and table of authorities but otherwise would remain the same as the original motion to dismiss. WHEREFORE, defendant respectfully requests that the Court grant leave to file a corrected motion to dismiss. Respectfully submitted, PETER D. KEISLER Assistant Attorney General DAVID M. COHEN Director
