_______________________________________________ ORDER CONTINUING SUSPENSION OF PROCEEDINGS _______________________________________________ Based upon a review of the parties' May 4, 2005, status report, proceedings in this action shall remain suspended pending resolution of the petition for rehearing en banc in Tesoro Hawaii Corp. v. United States, Fed. Cir. No. 04-5064. On or before the date 14 days after issuance of the mandate in Tesoro, the parties shall file a status report advising the court as to their intentions with respect to further proceedings in this action.
