POSITION STATEMENT OF WAYNE N. HARRIS AND KATHERINE ANN HARRIS CONCERNING DISPOSITION OF REMAINING MATERIALS IN THE "EVIDENCE ROOM"

COME NOW Wayne N. Harris and Katherine Ann Harris, pursuant to the Court's directive at the hearing held January 26, 2007, and with respect to the Court's proposal concerning the disposition of the remaining materials which are currently deposited in the "Evidence Room" which was utilized for purposes of discovery in the above two referenced cases, state as follows:

For the reasons set forth in their Combined Response filed in the above-

referenced matters on or about November 4, 2003, Mr. and Mrs. Harris do not believe the contents of the "Evidence Room" constitute federal records for purposes of the Federal Records Act, the National Archives and Records Administration Act, or any other law pertaining to the retention or disposition of records. 2. However, in order to bring closure to this matter, and provided all interested

parties and entities concur, including inter alia the parties and intervenors to the abovereferenced actions and the National Archives and Records Administration, and subject to an Order being entered the phraseology of which is satisfactory to all such persons and entities, and further subject to any and all persons and entities continuing to be bound by the confidentiality provisions of the previously entered Protective Orders and Orders and directives of the Special Master, Mr. and Mrs. Harris will not oppose the disposition of the remaining materials in the "Evidence Room" in the manner and in accordance with the procedures suggested by the Court at the January 26, 2007 hearing.
