Defendant EchoStar Communications Corporation is now known as DISH Network Corporation ("DISH Network"). DISH Network is publicly owned and traded on the NASDAQ national market under the symbol "DISH." Pursuant to D. Colo. L. Civ. R. 7.4, Defendant EchoStar Communications Corporation, now known as DISH Network, hereby discloses its parent corporations. Depending on the method used to calculate percentage of ownership, Fairholme Capital Management LLC could be construed to own 10% or more of the stock of DISH Network. The determination depends on the method used to calculate percentage of ownership. Specifically, the stock of DISH Network is comprised of class A and class B stock. Each share of class A stock entitles its owner to one vote with respect to corporate governance; each share of class B stock entitles its owner to ten votes. If ownership of either class is sufficient, then Fairholme Capital Management LLC could meet the disclosure threshold of D. Colo. L. Civ. R. 7.4.
