First Capital Agency d/b/a First Capital Group ("First Capital"), Roger Metzger
Associates, Inc., ("Metzger"), National Union Fire Insurance Company of

Pittsburgh, P A

("National Union"), Security Insurance Company of

Hartford ("Security"), Ray Baldwin and

Swain & Baldwin Insurance, Inc. ("the Baldwin Defendants"), Lockton Companies, Inc. and

Lockton Companies of Colorado, Inc. ("Lockton"), and Plaintiff Apartment Investment

Management Company ("AIMCO") (collectively referred to as the "Parties"), by and through
their respective counsel, respectfully move the Court pursuant to Federal Rule of

Civil Procedure

1 6( e) to modify this Court's October 25, 2005 Final Pretrial Order ("Pretrial Order") to allow 14

additional days for the Parties to fie their respective responses to the pending motions regarding
choice of law and challenges to expert witnesses, as identified below, up to and including March
30, 2006 (the "Motion"). In support of

their Motion, the Parties state:

CERTIFICA TION
Pursuant to D.Colo.L.Rule 7.1, the Parties have conferred with counsel for all other

parties in this litigation with respect to this Motion. Counsel for First Capital conferred with
counsel for Defendant Vito B. Gruppuso, and was advised that Mr. Gruppuso does not oppose

the Motion. All remaining parties have joined the Motion.
1. On October 25, 2005, this Court entered a Final Pretrial Order for this case, which
stated in part that briefs regarding choice of

law and challenges to the qualifications and/or

admissibility of other parties' experts must be fied 90 days prior to trial, or March 1, 2006.
(Pretrial Order, pp. 89-90.)

2. On or before March 1, 2006, the parties fied the following briefs regarding

choice of law and challenges to the qualifications and/or admissibility of other parties' experts:

Expert Witnesses Jon Karraker, Armando Castellini, Bryan Tilden, Joseph Launie, James Wells,
John Kezer, 1. Kent Miller, Robert Quinn, and John Costigan and Memorandum in Support
(collectively referred to as "the Filed Motions").
3. Pursuant to the Final Pretrial Order, the deadline for fiing briefs in response to

the Filed Motions is March 16, 2006. (Pretrial Order, pp. 89-90.) The Pretrial Order states no
reply briefs will be permitted. (Pretrial Order, p. 90.)
4. The Parties seek this extension in order to: (i) allow the Parties to pursue

settlement negotiations that may result in the prompt resolution of this matter, (ii) to permit the
Parties adequate time to analyze the multiple issues raised in the compendium of

Filed Motions,

and (iii) to permit the Parties adequate time to consult with their respective expert witnesses
regarding the applicable issues.
5. Federal Rule of

Civil Procedure l6(e) provides broad discretion to the Court to

determe whether a final pretrial order should be modified or amended. See In the Matter of EI

Paso Refinery, LP, 171 F.3d 249,255 (5th Cir. 1999). Rule l6(e) permits modification where it
will not unduly prejudice opposing parties, and in order to prevent manifest injustice. See Byrd
v. Guess, 137 F.3d 1126, 1131 (9th Cir. 1998), cert. denied, 525 U.S. 963 (1998) (setting out
four-part test for determination of

whether to modify pretrial order); Roberts v. Roadway Exp.,

Inc., 149 F.3d 1098, 1108 (10th Cir. 1998).
6. Courts apply a four-part test in determining whether a pretrial order can be

modified: "(1) the degree of

prejudice or surprise to the (opposing parties) if

the order is

modified; (2) the ability of

the (opposing parties) to cure any prejudice; (3) the impact of

the

modification on the orderly and effcient conduct of the case; and (4) any degree of willfulness or

bad faith on the part of the party seeking the modification." Byrd v. Guess, 137 F. 3 d at 1 131.

See also Koch v. Koch Industr., Inc., 203 F.3d 1202, 1222-3 (10th Cir. 2000) (applying four-part
test); Roberts v. Roadway Exp., Inc., 149 F.3d at 1108.
7. Here, all parties consent to the relief requested in this motion, and all parties

except Mr. Gruppuso join in the motion. Thus, granting the motion will not prejudice any party.

Further, the extension will aid the orderly and effcient conduct of the case, and there is no
willfulness or bad faith on the part of the parties seeking modification.
8. The requested extension does not change the May 30, 2006 trial date.
9. This stipulated motion is not interposed for mere purposes of delay.

10. Granting the motion may facilitate the prompt resolution of

this case, will not

unduly delay the resolution of this case on its merits, and will further the interests of justice and
judicial economy.
11. Pursuant to D.C.Colo.LCivR 6. ID, each undersigned counsel certifies that a copy

of this stipulated motion is being served on his or her client.
12. Pursuant to D.C.Colo.LCivR 7. IF, a proposed order is submitted with this

motion.

WHREFORE the above named Parties in this matter request the Court to enter the
Order attached hereto granting a 14-day extension of

time to fie responses to the Filed Motions,

up to and including March 30,2006.
