This matter is before the court on Defendant Kenneth Roy Weare's Motion to Release Funds for Payment of Restitution (doc. #208), filed April 7, 2008. The Motion is DENIED. Funds will remain in the Registry of the Court until the SEC files proof of costs and application for payment of preparation and payment of taxes and payment of any outstanding checks issues as part of the civil claims process following which the balance will be ordered paid to the Department of the Treasury.
