Pursuant to D.C. COLO.LCivR 54.1, the AngloGold Defendants respectfully inform the Clerk and the Court that they and the Plaintiffs have resolved their costs dispute. Those parties stipulate that $29,000.00 in costs will be taxed by the Clerk against the Plaintiffs and in the AngloGold Defendants' favor, on the following terms: 1. The Plaintiffs will not be required to post a bond or other security to secure the

payment of that $29,000.00 in costs pending appeal; 2. The Plaintiffs will not be required to pay that cost award until the exhaustion of

all appeals; and 3. The Plaintiffs will not be required to pay that cost award if the Court's judgment

entered on April 13, 2006 is vacated. Respectfully submitted
