PLAINTIFFS' NOTICE OF PROPOSED DEPOSITION DESIGNATION SCHEDULE

Pursuant to the Court's June 4, 2007 verbal directives and the Court's June 5, 2007 Order (Doc. # 516), Plaintiffs Charles M. Kovacs, Christine H. Bukala, Danny M. Trammell, Robert C. McGrath and Joseph J. Ragusa submit the following proposed deposition designation schedule:[ 1 ]

On June 15, 2007 Plaintiffs served counsel for Defendant The Hershey Company (Hershey) with the designated deposition testimony for Jennifer Eun-Young Chung, a fact witness ordered to give a deposition and also a member of Hershey's litigation defense team, and for Richard H. Lenny, Hershey CEO and Chairman of Hershey's Board. These are therefore omitted from the schedule. Plaintiffs are not designating the testimony of those witnesses who Hershey has been ordered to produce for live testimony, including Marcella Arline, Bryon Klemens, Kathleen McGrath, Thomas Smuda, William Rossi, Mary Oates Walker, David West and Pamela Zerphy. Plaintiffs reserve the right to designate the deposition testimony of these witnesses, as well as the former Plaintiffs in this case, and the Plaintiffs in the Texas Age Discrimination case arising from the same events as this case, should any of these witnesses become unavailable for trial.
