Plaintiff A Major Difference, Inc. ("AMD") hereby responds to Defendants Erchonia Medical, Inc., Erchonia Medical Lasers, L.L.C. and Erchonia Patent Holdings, L.L.C.'s (collectively "Erchonia") Motion in Limine to Exclude Testimony of Barbara A. Soltz, Ph.D. Concerning Any Opinion Not Disclosed Under Fed. R. Civ. P. 26(a)(2) ("the Motion") [Docket No. 210]. First, Erchonia appears to have accurately set forth the law concerning exclusion of non-disclosed expert opinions. Second, AMD concurs that whether an opinion that is sought to be presented at trial has or has not adequately been disclosed in reports or deposition testimony is a matter to be reserved at trial. Finally, AMD wishes to remind Erchonia that not only will AMD's expert witnesses be subject to applicable expert disclosure rules, but its witnesses as well will need to abide by those relevant rules of civil procedure.
