Banta, pursuant to Rule 47, Fed. R. Cr. P, , and this Court's Order of May 31st, 2006, and respectfully moves the Court for an Order granting this Motion. In support of such Motion, Defendant states the following: 1. The Court in its Order of May 31, 2006 directed the Defendants to

respond by June 12th, 2006 to the Government's Motion to Provide Exemplars. 2. Defendant Alberto Cabral has through counsel filed a well reasoned

and well thought out response as ordered by the Court. 3. Other than to note that Jose Alfredo Zapata does not suffer from

asthma, the statements set forth in Mr. Cabral's Response apply with equal force to Mr. Zapata. 4. Defendant Jose Alfredo Zapata respectfully moves the Court for an

Order allowing him to join in Alberto Cabral's Response.
